Introduction.
This Acceptable Use Policy (“Policy”) governs access to and use of services provided by Trial IQ Technologies, LLC (“Trial IQ,” “we,” “our,” or “us”). This Policy forms part of our Terms of Service and applies to all users of Trial IQ’s websites, platforms, APIs, analytics tools, integrations, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to comply with this Policy. If you do not agree, you must not use the Services.
Purpose.
The purpose of this Policy is to define acceptable and prohibited uses of Trial IQ’s Services in order to:
- Protect patient data and confidential information
- Ensure compliance with healthcare, research, and privacy regulations
- Safeguard platform integrity and security
- Maintain trust among healthcare providers, sponsors, CROs, and research partners
Scope.
This Policy applies to:
- All customers, users, and authorized representatives of Trial IQ
- Healthcare providers, research sites, sponsors, CROs, and partners using the Services
- Workforce members, contractors, and agents acting on behalf of customers
- Any individual or entity accessing Trial IQ systems or data
Permitted Use.
The Services may be used solely for legitimate business and research-related purposes consistent with applicable agreements and laws, including:
- Clinical trial feasibility analysis
- Patient identification and pre-screening support
- Research site enablement
- Sponsor and CRO analytics
- Operational research insights
The Services are not intended to replace medical judgment, provide clinical care, or independently determine patient eligibility.
Prohibited Conduct.
Users may not:
Unauthorized Access or Data Extraction
- Access data or systems without proper authorization
- Share login credentials or permit unauthorized system access
- Systematically retrieve or scrape data to create independent databases
- Attempt to bypass access controls or security safeguards
Improper Use of Health Information
- Upload or transmit Protected Health Information (PHI) without proper authorization and applicable agreements (e.g., Business Associate Agreement)
- Use the Services in violation of HIPAA, HITECH, or other privacy laws
- Contact or solicit patients in violation of applicable law or institutional policy
- Misrepresent patient eligibility, trial criteria, or site capabilities
Security Violations
- Introduce malware, viruses, bots, scraping tools, or automated extraction mechanisms
- Reverse engineer, decompile, or attempt to discover source code or algorithms
- Conduct penetration testing without written authorization
- Interfere with platform performance or integrity
Fraudulent or Misleading Activity
- Submit false or manipulated data
- Impersonate another user, organization, or research site
- Use the Services to compete by extracting proprietary scoring methodologies or models
- Mislead Trial IQ, sponsors, providers, or regulators
Commercial Misuse
- Copy, resell, license, redistribute, or exploit the Services without written consent
- Use Trial IQ outputs outside the scope of contractual permissions
- Develop competing services using Trial IQ proprietary information
Data Responsibilities.
Users are responsible for:
- Ensuring lawful collection and transmission of any data uploaded
- Obtaining necessary patient authorizations where required
- Maintaining the confidentiality of credentials
- Implementing appropriate internal safeguards
- Ensuring data accuracy and completeness
Trial IQ reserves the right to audit usage for compliance with contractual and regulatory requirements.
Security and System Integrity.
Users must not:
- Circumvent or disable security-related features
- Disrupt or overload the Services
- Attempt unauthorized integration or API manipulation
- Interfere with monitoring or logging mechanisms
All system access may be logged and monitored for security and compliance purposes.
Enforcement.
Violations of this Policy may result in:
- Warning notices
- Temporary suspension
- Termination of access
- Removal of data
- Reporting to regulatory authorities
- Legal action
Trial IQ reserves sole discretion in determining appropriate enforcement measures.
Reporting Violations.
Suspected violations or security incidents must be reported promptly to Trial IQ.
Records and Compliance.
Trial IQ maintains policies, procedures, and monitoring mechanisms to support compliance with applicable laws and contractual obligations. Users must cooperate with reasonable compliance inquiries.
Changes to This Policy.
Trial IQ may update this Policy to reflect operational, legal, or regulatory changes. Updates will be posted with a revised effective date. Continued use of the Services constitutes acceptance of the updated Policy.
